As a result, I am not liable for any problems that may arise from not reading my ToS. By commissioning me/attempting to commission me, you agree to the corresponding ToS.
Examples:
-Unforeseen negative events (e.g. becoming homeless, medical accident)
-Relying on caretakers/the government for an income, and it being suddenly revoked
-Political instability, and needing to redirect funds to evacuation or similar
Personal pronouns will always refer to TopazTimes (Leon). 'The client'/'the buyer'/'the commissioner' will always refer to the person (or people) that is employing my services.
I can draw any species, including humans, birds, and horses. I have several shading styles, which are detailed on my Carrd.
I reserve the right to use any footage I may have taken of my artwork for YouTube or TikTok videos. The client can request that I not do this.
-Anything in another creator's personal style
-Sex or fetish artwork
-Fanart of problematic media, or media that I am not comfortable with supporting for a different reason
-Political artwork
-NFTs
-Anything with the intention of being used to train AI
-A completed drawing in .png format
-The right to PRIVATELY use any WIPs I have sent
-At the client's request, an editable file of the drawing (.clip or .bmp)
-If requested before I begin drawing, a speedpaint of the artwork
I accept PayPal and Etsy (custom listing) as methods of payment. Alternative payment methods (such as Discord Nitro, Robux or gift cards) can be used for commissions under £20 in worth.
Payment is expected, in full, after the sketch is shown and all revisions have been made.
The client must have a full reference of the character, pet, or person that they want drawn, or be able to fully describe the missing details. I can also work on purely written descriptions, but this may incur an additional charge.
The client is expected to keep frequent correspondence with me until the piece is finished.
When posting/using my art publicly, I MUST be credited. Linking back to my Toyhou.se or other social media is sufficient.
If the client plans to use my work commercially, I must be paid an additional 65% of the original cost of the artwork. This is non-negotiable.
My artwork is my intellectual property. Do not repost, steal, trace or copy my work.
If the buyer commissions only a sketch, they may finish the sketch themself, or employ someone else to do so for them.
The client is only eligible for a full refund within twelve hours of receiving their revised sketch. Requesting a refund means that they revoke their right to my sketch.
If they request a refund later, then they will receive a partial refund proportional to the amount of work done. Their right to my artwork is also revoked.
A commission can be completely cancelled before it's been paid for. When doing so, the sketch can be saved for later or deleted. Doing this more than twice will have the client blacklisted.
Once bought, my suits can be used for anything. I do not control the public image of my suits, and neither do I have a right to -- they are the buyer's property once payment is made. As a result, no special ToS applies to my premades.
I reserve the right to use footage I may have taken during the suit's creation for YouTube or TikTok videos, and to use WIP photos on my social medias. If I am being commissioned, the client can request that I keep their suit a secret.
All of my suits have a three-month warranty which covers failed adhesives, popped seams, and incorrect sizing (that is the fault of myself, and not the client's measurements). It does NOT cover shipping costs, however.
Past this period, repairs can still be made at the cost of £20 an hour.
If the buyer wishes to repair the suit themself, I will gladly tell them what materials I used, and from which supplier.
Quotes are free, and can be acquired from me from any of my social medias. The buyer will need a character reference, a full idea of what they want, and patience -- I may be busy when the request is given to me. Even if I have given the buyer a quote, I reserve the right to refuse a commission.
The buyer must be over the age of 18 or have the full consent of their legal guardian(s) to commission me. This is non-negotiable. If the client is found to be under the age of 18 and not have the consent of their guardian(s), I will cancel their commission.
An order can only be placed after a quote is received and my slots are free.
The client is expected to keep frequent correspondence with me. If the buyer ceases to communicate with me and I require their input on a part of the process, I will stop work until they respond again. If the buyer does not respond within three months of my last message (assuming that they have paid fully upfront), I will tear down the suit and reuse its parts, or sell it if it is near completion/completed. In the event of the buyer resuming communication after three months, no refund can be claimed.
Payment is expected, in full, upfront. I can accept payment through either PayPal, Etsy (custom listing), or bank transfer.
Once shipping is calculated, a second payment is required after the suit's completion. This will vary based on the destination.
Payment plans are accepted on any commission over £300 in value; the buyer's circumstances can mean that I will accept a payment plan on cheaper items. After the initial deposit is made (this varies between items), I will begin my planning, initial drawings, and pattern-making. Only after half of the full value is paid will I begin working physically. If a buyer utilising a payment plan stops responding or fails to pay, work will cease until communication is re-established/payment is resumed. If the buyer does not respond/pay within three months, I reserve the right to sell the suit, unless special circumstances mean that it will be completed in the future for the original buyer.
Refunds may only be claimed if my suit does not resemble the client's character in a way the client has stated to me that they are unhappy with (and the dis-resemblance does not fall within the limits of artistic style), or if the client is for some other reason unhappy with my work before I have reached the furring stage. In the event of a refund being made, I reserve the right to sell the suit to another buyer, or reuse the headbase for a different project.
The first event warrants a total refund, while the second warrants a partial refund (50%).
An accurate shipping cost can only be given after the suit is completed, and will incur a secondary payment to cover. I do not cover shipping costs, nor will I contribute to paying them.
I am based in the UK, so depending on the buyer's country, they may have to pay additional import fees to have their package delivered to them. I am not in control of these fees, and it is the client's responsibility to know if to expect them.
Depending on the size of the suit, it may have to be shipped in several boxes.
In the event of a parcel being lost in transit, I cannot offer refunds. It is recommended that the client contacts the courier company ASAP to see what they can do.
I can hold a completed suit for up to three months while I wait for the shipping cost to be paid.
If the client performs any of these behaviours, they will be blacklisted from commissioning me in future.
-Requesting a quote for an unaltered copyrighted character
-Requesting a quote for a character that is not their own, and the suit is not being made as a gift (character theft)
-Being pushy, aggressive or condescending when requesting a commission
-Requesting a suit that is a direct copy of a preexisting suit
-Requesting that I try to mimic another creator's personal style
